The Delhi High Court on Tuesday upheld a single-judge order in 2021 that temporarily restrained Aqualite Industries from manufacturing and selling ‘hawai’ slippers which were allegedly similar to Relaxo Footwears‘ designs.
A division bench comprising Justices C. Hari Shankar and Om Prakash Shukla said Aqualite’s footwear were identical in shape and configuration to Relaxo‘s designs. The registration of Relaxo‘s designs was not, prima facie, liable to cancellation under Section 19 of the Designs Act, it said, adding that the single judge has “correctly injuncted Aqualite from manufacturing or dealing in footwear which replicates the suit designs or is deceptively similar, in design, thereto.”
