A former US Citizenship and Immigration Services officer has been arrested in Texas after federal authorities accused him of taking illegal payments in exchange for manipulating immigration decisions and speeding up applications. Lukman Owolabi Ganiyu, a former senior immigration services officer with USCIS, and Adeniyi Akeem Somoye were arrested on September 2 in connection with an alleged multi-year corruption scheme, the US Department of Justice said.A federal criminal complaint filed in the Northern District of Texas on August 31 charges the two men with conspiracy to receive illegal gratuities by a public official.

Multi-year scheme by two people

The case has put a spotlight on an especially sensitive area of the US immigration system: the alleged sale of access to government officials who have the power to approve or expedite immigration applications.According to federal prosecutors, Ganiyu allegedly used his position as a USCIS officer to manipulate immigration applications, while Somoye allegedly acted as his associate in the scheme.The two are accused of receiving illegal gratuities in return for helping applicants obtain favourable treatment, including unlawful approvals and expedited processing.The Justice Department described the alleged conduct as a “multi-year scheme” and said the investigation involved USCIS’ Office of Investigations, the Department of Homeland Security’s Office of Inspector General and the FBI’s Dallas Field Office.“Selling immigration benefits for cash is a blatant abuse of public trust,” US Attorney for the Northern District of Texas Ryan Raybould said after the arrests.He added that when a federal official “puts a price tag on lawful status,” authorities would intervene.The FBI also warned that corruption involving immigration decisions can undermine the integrity of a system that has implications for both lawful immigration and national security.“The alleged manipulation of immigration decisions for personal gain undermines the integrity of a process essential to our national security,” FBI Dallas Special Agent in Charge R. Joseph Rothrock said.

Why the case matters

USCIS officers handle a wide range of immigration applications and petitions, including cases involving lawful immigration status and other immigration benefits. Decisions or processing actions by agency officials can therefore have major consequences for applicants waiting to live, work or remain legally in the US.The allegations in the Texas case are particularly significant because they involve the alleged manipulation of that official process from inside the agency.Federal prosecutors have not said in the Justice Department announcement how many applications were allegedly manipulated, how much money the defendants are accused of receiving or how many immigrants may have benefited from the alleged scheme.Those details could emerge as the criminal case progresses.The arrests came amid heightened scrutiny of the US immigration system, with federal authorities pursuing cases involving immigration fraud and abuse from multiple angles. The Northern District of Texas has also recently announced other immigration-related prosecutions, including charges against individuals accused of illegal reentry and previous visa fraud schemes.For Ganiyu, however, the allegation is different: prosecutors say the suspected wrongdoing came from within the federal immigration machinery itself.Both defendants appeared before a US magistrate judge on September 2.If convicted of the conspiracy charge, each faces a maximum sentence of five years in federal prison and a fine of up to $250,000, according to the Justice Department.The case is still at the charging stage. A criminal complaint is an allegation and is not evidence of guilt. Ganiyu and Somoye are presumed innocent unless and until they are proven guilty beyond a reasonable doubt in court.Assistant US Attorney Chad Meacham from the Fraud Section is prosecuting the case.For immigrants and applicants navigating the US system, the case is likely to serve as another warning about the risks of trying to bypass official procedures through intermediaries or payments.Federal authorities, meanwhile, have made clear that alleged corruption inside the immigration system will be treated as a public-corruption matter rather than simply an immigration violation.
