A Pennsylvania man's 2018 vasectomy ended in complications and the loss of a testicle; eight years later, an appeals court has upheld a roughly $9.5 million malpractice verdict against his doctor and practice

A Pennsylvania appeals court has upheld a multi-million-pound medical malpractice judgment against a urologist and his medical practice after a routine vasectomy led to the surgical removal of a patient’s testicle. The Superior Court of Pennsylvania upheld the trial court’s decision to award damages to Matthew Brennen and his wife, Lisa Brennen, following a jury verdict in Fayette County. The lawsuit arose from a surgical procedure performed in October 2018 by Dr Jason A. Smith, a shareholder at Tri-County Urology Associates, Inc. The ruling ended years of legal disputes over care after the operation, delays in diagnosis, and failures to provide required records before the trial.

Surgical procedure and post-operative complications

Matthew Brennen underwent a routine vasectomy in October 2018 under the care of Dr Smith. According to legal documents filed with the Superior Court of Pennsylvania under docket number 1050 WDA 2025, Mr Brennen suffered extreme pain and serious medical complications soon after the operation. The Brennens later filed a medical malpractice lawsuit against Dr Smith and Tri-County Urology Associates, Inc. The couple claimed that the doctor had failed to carry out a proper examination before the surgery. They argued that this check was important for identifying possible risks and preventing the complications that followed. Medical experts who testified for the couple told the court that Dr Smith had failed to meet the standard of care expected of a specialist. Mr Brennen’s continuing complications after surgery and the damage to his tissue eventually forced doctors to perform a gonadectomy, a procedure that surgically removed his left testicle.

Fayette County jury verdict and damages breakdown

The case first went before a jury in the Fayette County Court of Common Pleas. The jury found in favour of the Brennens on all claims of medical negligence. The jury awarded Matthew Brennen $8 million in compensation for severe physical pain, emotional distress, embarrassment, and the permanent loss of enjoyment of life. The jury also awarded Lisa Brennen $1 million for loss of consortium, which covers the impact of an injury on a spouse and their marital relationship. Additional costs and penalties brought the total financial award linked to the judgment to approximately $9.5 million. During the trial, the couple’s lawyers, Michael Calder and Jennifer Webster, challenged the defence argument that the loss of Mr Brennen’s testicle was caused by an unpredictable episode of testicular torsion. This condition occurs when a testicle twists and cuts off its blood supply. The legal team argued that Mr Brennen’s age made this explanation unlikely. They pointed instead to failures in the surgery and the doctor’s diagnosis.

Appellate court review and evidence sanctions

Dr Smith and Tri-County Urology Associates appealed to the Superior Court of Pennsylvania. They challenged whether the trial evidence was strong enough to support the verdict and disputed penalties imposed by the trial judge. In an opinion written by Judge McLaughlin, the appeals court rejected the defence arguments and upheld the trial court’s decision in full. The court found that there was enough evidence for the jury to conclude that the doctor had failed to meet accepted medical standards. Writing for the panel, Judge McLaughlin stated: “The jury’s verdict is supported by substantial evidence that Dr. Smith did not meet the standard of care expected of a urologist during the vasectomy procedure.”The appeals court also upheld $60,010 in legal penalties and fees imposed on the defence for failing to follow evidence disclosure rules. The trial court had imposed these penalties because the defence failed to provide complete medical records during the required pre-trial exchange. Judge McLaughlin noted that the defence’s failure to provide the full medical records justified the financial penalty. The court highlighted the importance of sharing relevant information during the evidence-gathering stage of a civil lawsuit. The defence can still ask the Pennsylvania Supreme Court to formally review the case.
