A Louisiana woman who accused her uncle of transferring interests in nearly 300 acres of land from her late mother’s estate to himself has won another chance to pursue part of her lawsuit. The Louisiana Court of Appeal ruled on Wednesday that Jessica Gooden Walker could continue her claims concerning her uncle’s handling of the estate. However, the court rejected her other claims and cancelled a $10,000 damages award she had previously received. As per the ruling, the dispute began after Walker’s mother, Wilma Letitia Blake Gooden, died in 2003. Her will placed her estate into a trust for her two daughters, who were to share its benefits equally. Wilma appointed her brother, Robert E. Blake Jr., to manage both the estate and the trust.Walker later alleged that Blake had used his position to transfer interests in several properties in Rapides Parish, Louisiana, to himself. The properties involved nearly 300 acres of land. She claimed that he subsequently transferred or sold property interests to businesses connected to him without properly informing her.The legal battle began in 2013 when Walker sued her uncle over his handling of the estate and trust. More than a decade later, the appeals court has ruled that some of her allegations deserve further examination. It has not, however, decided whether Blake committed wrongdoing.

How the property dispute began

According to court records, Blake carried out several property transactions in May 2005, while he was managing his sister’s estate. One transaction involved exchanging shares in Emfield Development Corporation for estate property. The agreement valued six shares at $33,000 and the land at $6,450, with the estate making an additional payment of $26,550 to Blake.Another transaction transferred interests in two tracts of land from the estate to Blake for $104,534. Court documents show that a promissory note was involved rather than a direct cash payment. The estate’s remaining assets were subsequently placed in the trust, and Blake was discharged from his responsibilities as executor in October 2005.The appeals court noted that Blake later sold properties and timber at a substantial profit in 2006 and 2007. It also found evidence of further transactions that financially benefited him.Walker maintained that she had not been properly informed about the sales. She said a letter received in July 2009 sought her approval of documents releasing Blake from claims against him, but did not clearly disclose the earlier property transfers. She refused to sign those documents. According to her court filings, she obtained more information in September 2012 and later searched public records, where she found documents relating to the transactions.

Why the earlier court dismissed her claims

The case continued for years as both sides disputed whether Walker had waited too long to bring her allegations before a court.Blake argued that the legal deadlines for filing claims had expired. A lower court eventually accepted that argument and dismissed most of Walker’s claims. In June 2025, the lower court also awarded Walker $10,000 because Blake had failed to distribute trust assets on time. Walker appealed the dismissal of her claims, while Blake challenged the damages award. The main question before the appeals court was whether Blake’s responsibilities as executor of the estate should be treated separately from his responsibilities as trustee. The distinction mattered because different legal deadlines applied to those roles.

Appeals court allows part of lawsuit to continue

The appeals court agreed that Walker had filed her claims against Blake as trustee too late. It therefore upheld the dismissal of those claims. However, the judges found that the lower court had wrongly treated all the allegations as claims against Blake in his role as trustee. They explained that managing an estate and managing a trust were separate responsibilities, even when the same person performed both jobs. The court also found that the estate’s final accounting had not received the required judicial approval. It said Blake could not waive that requirement himself when he was both executor and trustee, because of the conflict between those roles. As a result, the judges ruled that Walker’s claims concerning his handling of the estate should not have been dismissed for being filed too late. They also rejected Blake’s argument that Walker could not bring those claims because the trust, rather than Walker personally, had inherited the estate. As a beneficiary, she had an interest in how the estate was managed. The judges made clear that whether Blake acted improperly remains unresolved and must be examined in further proceedings.

What happened to the $10,000 award?

The appeals court separately considered the $10,000 Walker had received for delays in distributing trust assets. Under the trust arrangements, she was entitled to receive half her share on September 15, 2012, and the remainder on September 15, 2017.The judges agreed with the lower court that the assets had not been distributed on time. However, they found insufficient grounds in the record to support the specific $10,000 award. They therefore cancelled that amount and directed the lower court to reconsider the issue after a hearing and explain its decision. The appeals court also upheld the dismissal of Walker’s claims under Louisiana’s racketeering law.The case will now return to the lower court for further proceedings on her allegations concerning Blake’s actions as executor.
