Canada government introduces new streamlined legislation to strengthen border security.

Canada has introduced a new version of Bill C-12, the Strengthening Canada’s Immigration System and Borders Act, to implement stricter border control. to stop crime, the flow of illegal fentanyl, crack down on money laundering and improve the immigration system. While Indians who are permanent residents of Canada will not be affected by the new bill, the environment is going to be tougher for asylum seekers, as the bill aims to protect the asylum system against sudden increases.

Asylum ineligibility rules

  • Asylum claims made more than one year after someone first arrived in Canada, after June 14, 2020, would not be referred to the Immigration and Refugee Board of Canada. This would apply to anyone, including students and temporary residents, regardless of whether they left the country and returned.
  • Asylum claims from people who enter Canada along the US land border between ports of entry and who make a claim after 14 days would also not be considered.
  • If someone enters irregularly (e.g., through the U.S. border or without valid documentation), it will become harder to claim asylum.
  • Claimants who already have status or applications in another safe country (like the U.S.) might now be automatically ineligible.
  • Refugee claims will be processed faster but with stricter screening. This can reduce waiting times, but may also lead to more refusals if the evidence is weak.

IRCC to gain powers to cancel, suspend immigration documents

Immigration, Refugees and Citizenship Canada will gain stronger powers to cancel, suspend, or alter immigration documents if they find inconsistencies or fraud.“The Government of Canada is committed to keeping our communities safe and working with our American partners to further strengthen our border. Bill C-12 will help advance key legislative changes needed now that will further equip our border and law enforcement agencies with the authorities and resources they need. We are ready to work with our colleagues in Parliament to ensure this important legislation becomes law,” Gary Anandasangaree, minister of public safety, said.
