Prime Minister Narendra Modi on Friday laid out the need for the bills proposing the removal of PM and CMs over denial of bail for 30 days since arrest, and said that such legislation has been introduced to fight against corruption.

Citing an example of a normal government employee who loses his job within hours of his arrest, the Prime Minister questioned why the PMs and CMs should not be forced to step down from their position upon arrest and no bail for 30 days.

“Today, no one should be above the law. But how is it possible that some Chief Ministers, Ministers, or even Prime Ministers enjoy power while staying in jail? If a government employee is imprisoned for 50 hours, then he loses his job automatically, be it a driver, a clerk, or a peon. But a CM, a Minister, or even a PM can enjoy staying in the government even from jail,” PM Modi said while addressing a public meeting in Bihar’s Gayaji.

In an apparent reference to AAP chief Arvind Kejriwal, who was arrested in an alleged liquor scam case in Delhi on March 21, 2024 but continued to remain the Chief Minister despite being lodged in Tihar Jail, the Prime Minister said that orders were issued from inside the jail.

“Some time ago, we saw how files were being signed from jail and how government orders were given from jail. If leaders have such an attitude, how can we fight corruption… NDA government has brought a law against corruption, and the Prime Minister also comes under its purview,” PM Modi said.

Kejriwal went on to resign from his position only after he was granted bail by the Supreme Court on September 13 last year. He had said that he would assume the post again only after being vindicated in the “people’s court” during the Assembly polls in 2025; however, he lost the election to BJP candidate Parvesh Varma from the New Delhi constituency.

What Are The PM, CM Removal Bills?

During his address, the Prime Minister referred to the Constitution (130th Amendment) Bill, the Government of Union Territories (Amendment) Bill, and the Jammu and Kashmir Reorganisation (Amendment) Bill — introduced in the Lok Sabha by Union Home Minister Amit Shah.

The Constitution (130th Amendment) Bill proposes that a prime minister, chief minister, or minister will be automatically removed from their respective offices if they are in judicial custody for 30 consecutive days and fail to secure bail during this tenure.

However, the condition remains that the minister must have been arrested for an offence that carries a punishment of five years or more.

The Opposition criticised the Bills, calling them “unconstitutional and undemocratic”.

The bills were referred to the joint parliamentary committee for wider discussions.

“I am about to make a request for the Bill to be sent to the JPC. JPC will have members of Lok Sabha and Rajya Sabha, ruling and Opposition sides. They will deliberate on this and bring it before you,” Shah said in Lok Sabha while proposing a motion for the same during the recently-concluded Monsoon Session of the Parliament.
