In a crucial development in the murder case of former Tamil Nadu Bahujan Samaj Party (BSP) president K Armstrong, the Supreme Court has allowed the Central Bureau of Investigation (CBI) to proceed with its probe while simultaneously staying a contentious part of the Madras High Court’s order.

Armstrong, a prominent Dalit leader, was brutally hacked to death outside his Chennai residence in Perambur on July 5, 2024, by an armed gang allegedly posing as food delivery agents. The initial investigation by the Tamil Nadu Police’s Special Investigation Team (SIT) led to the arrest of 30 accused and the filing of a voluminous 7,411-page charge sheet.

However, the deceased leader’s brother, KV Immanuvel, moved the Madras High Court, alleging glaring lapses in the state police investigation. The petition claimed that key conspirators were not apprehended, and the probe suffered from procedural lapses, including the failure to conduct an identification parade despite the presence of eyewitnesses.

Acting on this plea, the Madras High Court on September 24, 2025, not only transferred the investigation to the CBI but also quashed the entire charge sheet filed by the state police. This quashing led to a rush by the accused to seek immediate bail, raising fears of a serious law and order situation.

The Tamil Nadu government immediately challenged the High Court’s decision in the Supreme Court. A bench of Justices JK Maheshwari and NV Anjaria, while hearing the appeal, issued a split order. The SC stayed the High Court’s direction, which quashed the state police charge sheet, thereby protecting the investigation report for now. Crucially, however, the bench allowed the CBI investigation to remain in operation, declining to halt the central agency’s entry into the case.

The apex court’s interim order ensures that while the state police’s extensive work is preserved, an independent agency will re-investigate the matter to address the serious allegations of flaws and contradictions raised by the victim’s family, thus aiming to strike a balance between a meticulous probe and the need for public confidence in the judicial process. The CBI is now expected to begin its independent inquiry into the high-profile murder.
